some punk kid making decisions about my welfare

It appears that there is interest in what I am saying. Thank you for reading this blog. Yesterday , I realized that it wasn't so long ago that I couldn't remember what a mouse was. Not the little creature type. One reason I have been so slow in getting this done are the levels of pain I deal with and the brain damage. Assaults to the head result in brain damage in different ways. I am convinced that assaults to the neck, called whiplash, result in more damage than is acknowledged. Fybromyalgia being one. Another topic for another blog. I have so much to say.

Anyway, people say things regarding their experience that pertain to the need for reform. Yesterday someone said something about how a punk kid on the phone said their injury was due to their age not the accident. A doctor did this to me. She worked for the insurance company.

How to explain this? This matter is part of the whole medical insurance system. Obamacare will be a bigger nightmare than any can imagine. Our value as humans will be regulated by people who may have the moral character of a Hitler or Obama for that matter. I listened to Obama for 5 minutes when he was running for Pres. the first time. I knew he was a pathological liar. That's all it took. I judged his character. He was voted in and we get Obamacare. What kinds of people will be making decisions about our lives and by what regulations. My experience with the auto insurance industry has been a microcosm of all that will come in this area.

Back to my experience with auto insurance. In the book Delay, Deny, and Defend, Feinman brings up the topics of how these companies are determining what is paid for. It is an excellent read. I think my perspective is more centered on the real practical issues for the people.

For today I want to discuss how the phone lines are being used to take claims, then to deliver conclusions on these claims, never any real contact. Decisions are made by people now who are profit centered, some immature, undereducated, and controlled by others who are profit centered. Or like in the Vulture Culture, another book discussing insurance issues, it was revealed how adjusters in State Farm get benefits by limiting benefits. ( A group of Vultures is called a committee) Yesterday I addressed the insurance commission in Colorado. Most people realise that these commissions are corrupt all over the country.

Back to my original article. Who defrauds who? These actions were called stealing at one time. When our money that is supporting these companies is going to lawyers who should not be a part of the system, or doctors whose only purpose is money, making judgements about our well being, or some adjusters whose goal is to get enough for their libido desires, whatever that is. People using the auto as a weapon for gain. This should be called assault and battery, and should be punished instead of rewarded.

I received from the insurance commissioner's  a copy of a report from State Farm. A Susan Singleton , called a Section Manager, noted calls and statements by me and their employees. What parts were true or false, who knows.

It boils down to someone or ones at the top, making decisions about our lives and well being with money, profits and gains being the focus. This trickles down.

Solvency is critical in the insurance business. This is where good stewardship is critical in the leadership of the insurance industry. But as I think about where our money is going, it should  not be to  the self interests of people who care only about themselves and their self interests, but the people who support the system, a system that was established for the people and by the people.

Fear and futility are the emotions of our culture. I want to determine where my money goes. In this country that means we need people who we allow to run our country to have righteous minds, a level of decency, common sense.

The Insurance industry needs to become a service organization. Not a profit Center.

Our mind sets need adjusting.

Visiting the insurance commission,Denver

I was going to publish a letter to warren Buffet yesterday but while writing I realized I needed to do some more research.

Also while in Denver in July, I filed a complaint with the insurance commission. They did follow through. The complaint was handled by a Bruce W. Glaser, Senior Complaint Analst. I stated that State farm used various forms of fraudulent behavior to delay or deny coverage (in their words) their insured driver was 100% at fault. To summarize I wanted full payment for all damages, medical expenses and loss. AND prosecution of all parties involved in the fraudulent acts of State Farm Insurance Company who were involved in the concealment of infornation, blatant lies, and other forms of manipulation involved in the case.

State farm was asked for a summary of the claim.

I met with Bruce a couple of weeks later and was given copies of correspondence from the commission to STF and a 6 page "summary" from Susan Singleton, Claim section manager. I was accused of not wanting to speak to a Dave Baca to address my concerns? I guess this was some sort of questionable act on my part that may be in question. I don't know.

Bruce gave showed me the paper work and proceeded to justify the actions of STF because I had waited so long to contact the commission.I was going to get nothing and had no defense. That was it.

Now Bruce, a tall man in cowboy boots, so Colorado. I noticed because I dropped my cane and when picking it up, well I noticed the boots which were very expensive looking. He was formidable and not nice. It's as if he was going to put me in my place right away. I think this is also the good old boy mentality of Colorado. Bottom line, they did not investigate my complaint, I have evidence of their fraud and lies, and was not asked to present this. Bruce said he defended the law which I am familiar with, and he was not. i quoted a couple of terms and asked if he was familiar with them. I also asked if he had read Deny, Delay , Defend or my article. He had not.

I had always suspected that the commission was worked for the insurance companies especially from an experience I had in the 1999 accident. This experience confirm my suspicion. I realized he was impotent and told him so. My complete thought was "buddy you are in bed with the insurance company and that renders you impotent". He said another word for impotent but I stood my ground. I think it was the cowboy boots that drove me to it. and my age. My impression is that the insurance commission works for the insurance companies not the people. Back to my article. Read this if you haven't. It's posted as the original article.

I had a good reason for not speaking to Baca.I had already received a letter from their then attorney a Craig Nuss, which documented blatant lies.Craig no longer works for them.

What all this did was drive me to get the reform done. It is forming in my mind as I go along. My research into Geico and Warren Buffet's influence over the auto insurance industry is revealing. I cannot begin to grasp this mans genius but he has played a vital role in keeping these companies afloat. What I desire to ask of him on behalf of the good American people is forming in my mind.

How the piranha eats the shark, joining forces.

I have just spent an hour and a half typing a letter to Tom Griggs, a claims manager in Michigan. I hit some thing and it disappeared. I can't seem to retrieve it.
Essentially it was another request for payment of my claim. I am going to give out his phone #. Calls to him may be the way to get this accomplished.
claim # 31155180

His phone # 248-488-2723 or
877-823-6503 Ext.2723

My file was supposedly sent to Michigan several years ago. The fraud involved with my case is beyond comprehension. The consequences of not paying the essential claim beyond description.

Tom, I left a message on your phone saying I was writing a letter to you on my blog. writing this blog takes such a long time for me and I lost it. My hands tremor and I probably hit a wrong key. Please send notification of payment of settlement to martamoran23@gmail.com
I left a demand letter at the Farmers, on Hampden in Denver, CO. I know the money has been released. I am destitute. Money will relieve some of the pain and suffering. Your delay actions have been cruel and criminal.

To the readers:
I am reading a book called Thick Face-Black Heart
the author has key points and one that may fit this enormous endeavor of how to get real reform is "How a piranha eats the shark" One piranha can't do much against the shark but multiple piranhas. You get the point. people have said to me "it is just too big". I am one small voice but multiple voices can make an impact. I have been contemplating a strategy. It is our money! Call Tom Griggs. No more nice lady. I will be posting more contacts.
Help get this reform out there! It is our money.

visit to Farmers Insurance, Denver, CO

Farmers has a large office in Denver, Co. I had been calling a Tom Griggs in Michigan regarding my claim. Several years ago my claim had been sent to Michigan and I was told to contact a Jim Kelly. Tom Griggs is Kelly's super or that is what they claim. My back injury has never been resolved. I had approached the Farmers office here before they closed several times with requests for treatment. The last person was a Mary Anne, before her a Greg Jarvis. There has been a lot of progress regarding back injuries and I had found a treatment that was safe and showed a high percentage of success. However these treatment centers were in other states. I was again ignored or told some story to way lay my attempts of getting recovery.

I have this time problem. I seem to be in a state of lethargy due to the brain injuries and the pain.God, why am I still alive.

I decided to get my money! There is treatment that will alleviate much of the pain and maybe correct the back injury, 13 years old now.

Hence, another trip to Denver. in the book Deny, Delay, Defend, the author describes the practices of claims adjusters. I had an interesting encounter. They can be evasive but this time I was told to "drop dead" The receptionist went to the back office, i had requested to speak to someone regarding finishing my claim. I heard the female she was speaking to say "tell her to Drop Dead".A young woman came out who was there to console me and tell me my claim was given to Jim Kelly. I told her that I had been in touch with him and his supervisor over the years. The harsh looking blonde female, came out of the inner office and while passing in front of the receptionist pointed at me saying "is that her." I am a plain looking, but stylish, 68 year old lady. Trust me I've wanted to drop dead many times. I even called the hemlock society at one point but when they seemed so eager to help me drop dead, I decided to not give them the job.
I was stunned again.
I returned the next day with a demand letter. Then went back a couple of weeks later. No results. I will be contacting Tom again. There is money for me. I lost everything and have been living in or out of my car for years.
I insured both of my houses with Farmers as well as several cars. When I took out the policies the first time, Colorado was a no-fault state and offered complete coverage whether an accident was your fault or not. State statutes backed the policy holder. Due to the incompetency of claim reps Avis Duncan and Paula Chase and the guy I mentioned before who was running the Colorado Springs office, I was sadly treated.
What is hard to grasp is that I was physically and seriously injured, and vulnerable.   In a great deal of pain. I Was in a state of confusion. These reps are there to guide. How I was treated was reprehensible. They even sent a letter stating that my policy was not in effect at the time of the accident. They told me I would not need an attorney. I did try to hire an attorney by writing out the case and delivering this to several, about 10. One finally said that the case was complicated and that they would not make enough money off of me.It was so confusing. I had no idea what they were talking about especially with those I spoke to directly. Colorado Springs had a conservative reputation, with low settlements.
This is probably the largest bad faith case out there. But who to turn to. The insurance companies are required to pay. They pull the statute of limitations card out but this means nothing. In case anyone out there gets this thrown at them.
This accident unveiled a corrupt cop, documented. More evidence would reveal that the couple in the other car were not honest. Like there were two separate accident reports, both with false info, but one even had more people in the other car than there were.
I am tempted to give Tom's phone number out. He sounds like a decent man and may be trapped. I have got to be a thorn in his side.  Sorry Tom. JUST GIVE ME MY MONEY!"

the original article

July 25, 2012

Since 1999 I have been experiencing a wakeup call. Not unlike the Tea party Movement that would take place about seven years later. November 1, 1999 I experienced the first of 3 auto accidents and an elevator accident. I was seriously injured in the 1999 and 2008 accidents, then again in the elevator accident. I had the naïve notion that should I experience an auto accident in which I was injured my insurance would cover the experience.

The November 1, 1999 event started a series of incidences that would unveil how corrupt and complicated the auto insurance industry is, as the books the Vulture Culture and Delay, Deny, Defend would reveal later in 2010. About a year after the 1999 accident I came across writing by Richard E. Stewart. He wrote in 1978 what I was living through and some of what the other two books would cover more extensively. They all emphasized the need for reform. Not just lowering payments.

I was well insured by Farmers who started to pay along the no fault lines the state of Colorado had at that time but after a few weeks they started some delay tactics then denial. I contacted several attorneys in Colorado Springs, Co. One after another said they would not take my case, reasons being- El Paso County was too conservative and settlements were low, my case was complicated and that an attorney would not make enough money off of me.

During this time the thought that these companies are using our money to support a system that is complicated and corrupt instead of stewarding our money for the benefit of its supporters kept coming to my mind. I kept thinking – But It’s Our Money! Sounds like the outcry of the Tea Party movement. Then the question – why are we allowing this?

Colorado would change from the no-fault system to the tort system. This would establish an even greater no win situation for the consumer, essentially, defrauding the American middleclass. Also auto insurance would become mandatory. It is a form of taxation. Sounds a little like Obamacare to me. Now in all 50 states, auto insurance is mandatory. There are also punitive laws now for not having insurance.
Again it’s our money!

Some thoughts and questions!
·         Are insurance agents still paid a commission off of mandatory payments?
·         Lawyers scam the system making everything complicated. It’s our money!
·         Adjusters (claim representatives) make decisions managing our money based on computer programs and company profits as well as their own benefit. Special favor and awards-like the Vulture award (State Farm) are given out to employees.
·         Medical personnel are paid to minimize physical consequences of injuries endangering the welfare of victims. Bottom line they lie.
·         Then there are those who use the vehicle as a weapon to cause an accident with monetary gain as their motive. This is criminal. There seems to be no thought of the consequences of injury or the possibility of manslaughter.
·         Why do these insurance companies spend so much on advertising when insurance is mandatory?

Our money supports this!  Why are we allowing this?

The cost to the medical field is huge when an insurance company does not pay the medical bills they are required to pay. In the tort system one’s own insurance pays the medical. A lien is placed on any settlement. In my case there have been no settlements. In the 2008 accident State Farm offered a measly $42,000 with an initial medical bill of $25,000 which was covered by Medicare. I asked the attorney I hired-what would happen when Obamacare stepped in and my injuries from the accident would be considered preexisting should I live. Would this become a decision of some review board? His response was that Obamacare would not step in until 1014. Maybe he thought I would not be around by then.

We pay coming and going.

I read this statement in one of the writings. “Pursuing an insurance claim is like running a marathon on a stretcher with IV’s.” In my case it has been worse.  The system was set up to insure recovery not hinder or prolong it or even destroy the chances of recovery.

Yes, there is fraud against the insurance companies but I suspect that it is nowhere near what the companies claim. The real fraud is toward the real victims of vehicular crime. For example in situations where someone runs a red light, drugged and drunk or setting up accidents or neglecting to post warning signs of dangerous, faulty equipment and the insurance company delays, denies or forces a claimant to defend. Then there are waste and other forms of mismanagement of our money.

Who defrauds who?

back again, brain shut down for r&r and immigration reform

I am in Denver , to start a protest at the Farmer's building on Hampden. Today I have $9 til the 3rd of July. Wouldn't it be something to get one of the settlements. As my brain has been on the mend I have  been grasping the depth of depression I have been living under. Because of the pain medication I take I can't take any medication for depression. I challenge it with my exercise and diet but this is like treating a tsunami with sandbags.  Immigration reform has a special meaning for me. Since the first run in with an illegal using their vehicle for gain, I started researching the  problem of the "Hispanic" population. I grew up in Tucson, Arizona, 60 miles north of the Mexican border. The last time I was there was in 1991. The population in Colorado Springs, Co was minimal by comparison, in 1991 the year I moved up here. It has radically changed since then. I never paid attention to the movement, but even in Tucson the crime rate involving the Mexican community was higher. Crime escalated in the Springs as the Mexican population grew. Coincidental?

In 2005 I believe an illegal female drove through a red light staring at me. The light had changed on my side and even another car had driven thru on my left side. I spotted the car moving in front of me and was able to stop. I didn't make contact but she moved her car into mine and caused a scratch on he door. There was another woman in the back seat. It looked like she was holding a baby. I drove through the intersection and stopped on the other side. Her car hooked onto my bumper and dislodged it.
Eventually she had a Hispanic clerk in the court system here get a judgement of around $2500 for her door. The reason for the claim which was written on the court document was that "I didn't care". ????
Then the 2008 drunk drugged Hispanic running a red light, totaling my car, running from the scene, on foot. Then claiming not to have insurance. As it turned out he was driving his girlfriends car. The girl and her parent had insurance. He was caught by one of the cops who came to the scene. I would have to go to the retribution department of the District Attorney's office where I would meet Kalid from Morocco, an assistant attorney. He was giving Daniel Vasques community service and classes for drunk driving. I was seriously injured, a head wound, neck and arms, TBI. He had a rap sheet a mile long. I asked if he was illegal and was told by Kalid that that could not be found out unless he got jail time.

I wrote to the judge and asked for stricter discipline. There was some drug connection. I was 62-63 at the time. I had heard about other cases where elderly people were hit, generally in intersections. I wrote about my experiences to President Bush when the amnesty issue was upfront in 2007-8.

A couple of weeks ago I was at King Soopers, a local grocery market. The woman waiting on me was a Hispanic. There was a young man standing there who gave me a dirty look. She said something to him. I said he had a bad attitude. She said he had been in an accident the night before, he was her son.
She even said it was in an intersection, the fault had not yet been determined. A couple of nights later after leaving 24 hour fitness, a young Hispanic pulled out in front of me from a side street. I jammed on my brakes. Paranoid, I don't think so. Statistics would support my theory. Oh yes, I was also told that although witnesses and all evidence said that the 2008 accident was Vasqueses fault I might be made at fault. As it turns out he was 100% at fault. Duh! I considered that it might have something to do with the insurance coverage involved. So complicated.

PEOPLE WE HAVE GOT TO WAKE UP!

Have you ever looked up La Raza, The Bronze nation. I was shocked at first.

Liberty, what is it

May 30, 2013

Do we really understand what liberty is? If we don't understand it then how would we know if we loose it?

This is my understanding!
I think of liberty as having a right to make my own choice without coercion or intimidation or subjection to the inconsistent, arbitrary wills of others, like bureaucrats or my arch Nemesis's, insurance claims adjusters. I have to look up the plural for Nemesis. Maybe nemisei?

I've experienced every negative aspect of the human condition and began to wake up to it starting with the Nov. 1, 1999 auto accident. I have also experienced how other cultures in our society perceive liberty. It is viewed as freedom. And freedom to many means that they can do anything they want regardless of the consequences. With two accidents out of the Mexican culture I experienced the terror of coercion, give me what I want or we will hurt you. I say we because of their familia mentality, some kind of twisted cultural loyalty thing. I believe strongly from what I have seen over the last 12 years is going to manifest in an evil within our borders like we could never imagine. A bronze nation of sorts wanting our resources.

Insurance money is one way of extracting money from the USA, never mind that people are being injured. How many of the white culture have done this in some fashion. The use of vehicles as a weapon for gain is a subject that must be addressed. This is part of  the reform I want to see happen. These are not victimless crimes. The injuring or death of people is criminal. Then you add on the money, this is theft. We are talking assault and battery, manslaughter, murder. If the accidents were planned and some one dies as a result, would this be considered 1st degree murder? I asked this of a district attorney. The assistant district attorney Kalid who was prosecuting the drugged drunk driver who totalled my car by running a red light, totalling my car, running from the scene, while I was bleeding from a head wound, was going to give him some community service and drunk driver classes. The kid had a rap sheet a mile long.

Liberty and justice have gotten so twisted. How did we get so low?

What ever happened to common sense? Why have we allowed bully cultures into our society and the appease them in the name of a thing called tolerance. Is any of this tied to our concepts of liberty.

Liberty for me also means I have a right to live righteously, to exercise decency. I am studying the righteous mind and moral psychology. More on this. Will it be possible to reform the insurance industry? Will it take a public takeover to restore sanity?

some thoughts on who we are

May 28, 2013

Recently in a conversation with someone at the library, I heard again the complaint about the growing fact of how decisions about our well being are being made by unprofessional, ignorant, uncaring self-motivated people. In too many cases that is. Many are young and inexperienced. This is in the medical field and will become more apparent with the onset of Obamacare. It was especially true in the auto insurance industry and one of the main reasons I desire to get some real reform.
How to get our right to choose back. AGAIN IT IS OUR MONEY!
So do you have any value? Intrinsic value. Not the value you rate because of your gender, age, race, social class.
In Colorado Personal Injury Practice, there are 4 volumes devoted to the this area alone. They use natural language, that is language we the people can understand. The rules are there for the people. But again because of the complicated tort system geared toward lawyer involvement we loose. As I was reading today I again realised that we are the boss in these situations. Somehow the legal system has intimidated us into believing that we need them. Of course their monetary gain is the issue. Is it unjust enrichment. Yes it is.

We need a change in our thinking. There has to be something from my ancestry that motivates my sense of justice. I am a daughter of the American Revolution. My father's family history goes back to the early days of our country.I instinctively know the reasons this country was founded and still believe that we the people can make a difference and do justly. I guess it could be called a righteous mind.

Since the 2008 accident and the brain damage that came with it I began to value and appreciate my mind in a new way. I have had to fight to get a lot of the function back. The delays in posting on my blog are because as I use my brain it tires out. I had another blackout recently which scared me and it cost me some time. If any of you are true believers in Jesus please pray for my healing and strength as well as financial resolutions that will make it possible to get what I need for healing and basic comforts. like a place to live and good food. Also vitamins etc.

I've also seen what a generous people we are, those of us who have a history in this country. The most generous are those who have an authentic faith in Jesus Christ.

You are so valuable. Say to yourself 3 times a day "I am valuable. My right to choose is valuable."

What we need is to have a set amount of funds like a trust set aside to cover the cost of an auto accident. I haven't worked out the details but I want to meet with Insurance companies and get this done. We will manage our money or have a trustee to do it. There is a way to do this.

consequences

May 20, 2013

On Dec. 7, 2001, I wrote a letter to the then CEO of Farmers Insurance Co., Martin Feinstein. I did this based on an article in a Readers Digest that gave suggestions on how to handle an auto accident. I already was aware of the difficulties but thought that a letter to the top guy would get some results. Of course he was not in. The naivety of our society is profound.
I started with: "The trust and loyalty I have placed in Farmers Insurance for many years has not been merited with regard to an auto accident I was in November 1, 1999. For this reason I am turning to you for help in getting the lost wages and medical treatment I deserve and desperately need. There have been so many complications, but for the sake of brevity I hope to make this letter a brief overview of damages and injuries, and difficulties I've encountered with the claims department here in Colorado Springs.I then listed injuries, state statutes, lost wages, consequences of failure to receives the benefits of my policy. By this time I realized that our policies are contracts and should be treated as such. Some of the consequences listed from failure to receive the allotted PIP wages and medical treatment were-Repossession of vehicle, compounding inability to access appropriate medical treatment and all personal needs, Forced to live on Social Security disability and food stamps, inability to purchase basic needs for granddaughter and self, inadequate funds to sustain mortgage, payments, Isolation, Excessive pain, to the point of drug addiction, depression, and contemplation of suicide. I wrote "There is no way to express the anguish of the last two years of my life."
It was a demand letter as I would find out later, although I was not demanding. My southern genteel manners were apparent. There was more. By law and by right I should have been paid. i expressed in my article the difficulties I faced with the lawyers in Colorado Springs. What I faced was called conservative and if this was conservative then it was everything right gone a muck.
The focus on settlements is base on a sum of money that does not reflect the needs in  the initial recovery process nor in the long term needs.
!4 1/2 years later I rely on drugs just to function on a very basic level. There have been more days where I have not been able to do more than get myself to the bathroom, my policy afforded me funds for help in the first year. I had none. I was to receive rehabilitation in every area, physical as well as work related. None. I tried over the years to get them to do what was right even filing my own lawsuit but without the funds I could not pursue this.
I think back on Catherine Catherman who said to me "now why would you need money". Part of their strategy to keep from paying. They do this to people who are suffering. What I don't get is that they are supported by the courts. Fraud is the least of the charges that should be brought against them. I have not been able to get the name of the original manger of the claims department on Academy who was the person responsible in the beginning. He was there in November of 1999. He was also supposed to be a friend of my agent Bob Yaswa. Later, someone named Jarvis was there and I approached him. Nothing. The names
of others are in my files. I would like to see jail time for there crimes.
Yes it was a long time ago but I have suffered the consequences of their choices to not do their fiduciary duty.
I am a follower of Jesus Christ. And forgiveness is part of the plan and has been granted but justice is also part of His plan.
Why do we need reform? There are many whose lives have been destroyed not just by the accidents but by these leeches of society. AND WE PAY THEM TO DO IT.
Are we stupid or what?

from the beginning

I've decided to start from the beginning or from the article I published which gives an overall summary of the problems involved with the system.  I just learned how to copy and paste so I'm commenting at the end of the article. Don't want to mess things up. I'm learning as I go. I had to relearn the computer all over again after the hits on my brain. I'm thankful for our free library system especially in Colorado Springs, Co. I have had some physical setbacks which have hindered my ability to write but I am back and have a new strategy.
I have some ideas about the solutions. The how to get this done is lacking. I hope to get some comments from my readers regarding solutions and how tos. There are many who have run into like problems in the auto insurance industry but in the medical industry as well. One thing that is probably the most provoking is that the level of incompetency, self interest, personal gain(often times fraudulent) is so prevalent. Stupidity is rampant. Lack of common sense, the norm.
I have been reviewing the statutes, court practices, rules etc. regarding lawyers. It is all so complex. somehow we need to get the power out of their hands. I also went back to the French Revolution,  Russian Revolution and even the Spanish Inquisition. Searching out the root causes. Having a guillotine placed in the town squares of our cities is not the solution.
All that I've experienced is a microcosm of much of what is ailing in our society. I will be breaking this down and explaining some my conclusions. I'm done for today. Please notify others about this blog. I have not received funds yet and need your prayers. God has kept me alive and through Jesus I have had incredible healing especially considering I've had little or poor medical assistance. With out the funds from the insurance I am very limited. Prayers are needed for me but also for us all. We have been duped into an unconcious state of existence.

culture of corruption

April 25,2013

What was that about committment to blog every day. I have no money for gas to get to the library. This is a consequence of the U-haul storage elevator accident Republic Western Insurance Company is the Ins. company that handles U-haul. In January 2010 I was entering the two story facility via the elevator. As I was pushing my cart into the service elevator thr smaller metal portion dropped on my head. About a week later I was in the hospital with a stroke. The initial cost was $18,000 for just one night. They don't want to pay, obviously. Oh yes, the manager of this facility Morgan Blau was right outside. I staggered out and told him what happened. He replied that he had hired a Nit-Wit? who over oiled it. He didn't mention anything about whether I was hurt or how bad. Nothing. Our society? I was watching the dedication of the Bush Library today. America is still upheld as The Great Nation. I remeber a book called the Culture Of Corruption. It focused on politics. The left. When McCain was running against Obama they sent out a questionaire over the e-mail. There was a question about the biggest problem facing us. I wroet about the crime level. What will you do for money? What does the "church" do for money and where does go. Since the 1999 accident I have given this a lot of thought, because of the very real christian element in the 1999 accident. Also how I've been treated during this time.  I've been made aware of the corruption in the medical establishment. The judicial. and above all the lawyer angle. But it takes people to activate the rest. Soooo
What exactly is the culture of corruption.
We have all heard things like when wrong becomes right, or there is no more common sense just a lot of nonsense, the whole thing of tolerating behavior that not that long ago was considered immorral. But then I was talking to a woman 46 years old who said to me "what are morals?' How did we loose this concept?
How tied to the church is the culture of corruption. Whatever happened to SIN?

Injustice

April 22, 2013

If an accident is staged and the parties involved who staged the accident are not held accountable and even paid by the insurance industry for their efforts- A thought. Because this is exactly what I experienced. In the 1999 accident I experienced a corrupt cop who wrote two separate accident reports both with false info that made it appear that I was at fault. As time went by there was  evidence and remarks made by people involved that pointed to this conclusion. What if these people sat in churches around the Colorado Springs area.? The cop had a radio station on, with a nationally known preacher/teacher. Charles Stanley. While I was waiting for this cop to speak to me, Charles was speaking about a black heart. I wrote about this at that time. The accident had to have been arranged. There were several indicators at that time that revealed this was a strong possibility.Over the next couple of years there were more.

In 2005 I experienced an minor accident where a Hispanic woman drove through a red light staring right at me. I was able to stop without hitting her but she moved her car into mine and put a scratch on it. A car sped by me on my left and would have totaled her car if she had not stopped in front mine. There was another woman in the back seat holding what looked like a baby. Eventually she and a Hispanic employee at the court house would get a judgement for a couple of thousand dollars for the repair of the scratch. The reason given was that "I did not care about her." Who didn't care about who? This is documented.

It was a bit too obvious. it was done for financial gain. She should have just gone her way and tried again. I was in a moral quandary. She eventually took responsibility and I could get money from her company. I would have to pay her the judgement she got. After all the self righteous Christan's are doing it. Eventually nobody got a dime.

The 2008 accident a drugged, drunk Mexican ran a red light totaled my car then ran from the seen. He was caught. I was seriously injured. He claimed to not have insurance but he was driving his girlfriends car and it was insured by her and her mother. It would be a couple of weeks before I would receive that information. There was some kind of drug connection also. It was obviously his fault but I would experience a new angle this time. My insurance company told me that they were trying to get out of it's being his fault. The mother didn't want to pay. The little assistant district attorney (Kalid) would want to give him community service, and classes on drunk driving. He had a rap sheet and very likely was not a citizen. There was likely a drug connection.
I found out that personal injury protection had been taken out on their policy the month before the accident. Coincidental?

The story of their insurance company is in a previous blog. State Farm and Enten.

I was not paid in any of these situations. My story needs to be broad casted nationally. It is huge and reveals all that is wrong in our so called justice system, insurance industry, society and I dare say the church. I have also experienced the nightmare of our bureaucracy.

Why don't these people think about the consequences of these actions? As an authentic victim I have lost everything. I live with horrible pain, seizures, brain damage, physical limitations, I have become destitute. I have only existed over the last few years. Despair and depression have been companions to much of the time.

If the church goers are doing it why not everyone else. What will people do for the dollar?

The automobile is being used as a weapon for finacial gain. Is this theft?  People are being injured.
Is this assault with a deadly weapon? I have been kept alive for a purpose.

injustice

April 21,2013

Yesterday, I started to look at who are the criminals in our society.Yesterday I saw someone with a T-Shirt that said"when injustice becomes law then rebellion becomes duty". Back to lawyers creating a foundation for corruption, or is it that they have created a foundation, atmosphere for widespread injustice. Thinking about this they couldn't do much if they didn't have co-conspirators, namely people. In relationship to the auto insurance industry and my particular circumstances I was hit in the gut by the injustice surrounding the whole system. Money, greed is at it's core. I was also aware of what I thought I had by purchasing an insurance policy(contract). There was semblance of justice.

Auto accidents are not always accidental. In all of the situations of "accidents" there was an element of deliberate fraud. I will elaborate on this starting tomorrow. There is just so much. I want to make the public aware of the corruption. Try to get people angry so that more voices will speak out and say enough. I have thoughts on reform that would bring about a level of justice. I want to meet with Warren Buffet (Geico) and hash out some ideas that will benefit the people. Sure.

I have made a commitment to post everyday. Another topic I will elaborate on surrounds dealing with adjusters and the personnel of the insurance companies.

Yesterday I told the story of a Farmers adjuster, Katherine Catherman." Why would you need money?" was a comment she made when we were discussing a settlement. Well I don't know ?
I puzzled over this remark while shaking my head. I don't remember if I responded because it was such an insane comment and stunned me. I was thinking "unbelievable". By the time I got to Katherine I was into a couple of years of dealing with Farmers. I knew how ridiculous dealing with these people was but I was still going to try. I also thought "what planet do you live on"?

Some more thoughts surround the idea of federalizing the system. That is a very bad idea.
This was brought up in the Vulture Culture. I think the guy who wrote this is an attorney. Please make some intelligent rational comments. This is something that will effect all at some time. Since auto insurance is mandatory it is like a tax.

Who are the criminals?

April 20, 2013

After writing my lasy blog I realized how little we know about fraud, extortion, swindling. These actions happen to us every day. In relationship to lawyers, just how prevalent are these practices. Lying is fundamental, as my last posting exemplified. I had mentioned Enten, the attorney, using Greg Alderman to sell people on using Enten to represent them. When I met with Enten to discuss settlement, I asked him about Greg. He told me he didn't know anybody named Greg Alderman. I had a business card with Greg's name as a member of Enten's firm.

When fraud is mentioned in relationship to the insurance industry, one thinks of the people committing fraud. In my case I was lied to, manipulated, coerced, and ultimately swindled.

What is fraud? Legally fraud covers a wide area. But a simple definition is using deception to get something from someone, to trick someone into surrendering what belongs to them, even a right. How about extortion?
Illegal use of one's official position or powers to obtain property, funds, patronage.
To extort is to obtain by coercion, intimidation, or psychological pressure. To swindle: to cheat or defraud of money or property.

When dealing with claims adjusters I found that they learn how to twist common sense into nonsense. I had an experience with a Katherine Catherman, a Farmers adjuster. At least since the only contact is made over the phone one does not know really who they are. In a conversation about settling my claim from the 1999 accident, money was the topic. She said something that had me shaking my head in wonderment. She said "why would you need money"? The context had nothing to do with specifics, like I would need to pay my mortgage or a debt, maybe by food. It had to do with settling my claim. It was not in jest either. These are practices to discourage the people. I have multiple examples as I am sure anyone who has dealt with an insurance company has. Could these practices fall under extortion or defrauding someone of what belongs to them under their insurance contracts(policies) .
So, what is fiduciary? Of or relating to a duty of acting in good faith with regard to the interests of others. Held in trust.
Is this concept of trust part of our culture today, even remotely.
There is moral responsibility isn't there?
From what I have experience I believe I could put together a few cases that would have some of these insurance people, lawyers, even medical personnel in jail.
How to reign this industry in?

What to do about lawyers?

April 18,2013

Continued from April 17

I was called to come to Denver to speak with Enten's assistant. They had put together a demand letter of which I was given a copy. This assistant made a suggestion that we settle the State Farm claim right away. I believe the elevator accident had happened.I know that I told them about it when it did happen. I was not able to think through much at this time. I was able to read simple books and do simple puzzles. I don't know if I could write much. My short term memory was not improving but my long term memory seemed be really good. I could remember things from the past, unless it was having one's life flash through your mind because it is the end. There were days I thought my next thought would be my last. Just using my brain to read a short while would put me to sleep for 3 hours, any time of day. I slept in the library parking lot for about 8 hours one time.

(The following is an example of my lunacy, if this is a word. Just to letting you know. You may not want to put your time into it.

I would loose days at a time. One of the funniest episodes I had was showing up at a graduation that was being held at Woodmen Valley Chapel. I was attending the Saturday night service in those days, when I could. I showed up at the normal time for the service- there were cars there per usual. I looked up and saw some young people in graduation gowns outside the front entrance. I went in as usual, using the elevator to the main floor. As I was going in I noticed a bulletin for the graduation on the counter and decided to get one. It had such a pretty cover. I went in and sat there waiting for the service to start and for the people who appeared to be part of the graduation, to leave. But then I noticed more people coming in dressed nicer than the usual Saturday crowd. I believe I waited about twenty minutes after the service starting time and finally decided that the church had forfeited the service time for the graduation ceremony." Wasn't that such a nice gesture." I decided to leave.  My brain was telling me it was Saturday. I walked out of there still thinking it was Saturday. No one could convince me otherwise. I had done everything I would normally do on that day that I would do on a normal Saturday. It was Friday. If anyone had tried to convince me otherwise I would question their sanity. I still don't know what these episodes are called if anything. I would wake up the next day and live out the correct day. Another Saturday. I had the bulletin and wondered why I had it.I had a couple of friends give me their business cards with instructions to call them if this lady(me) started arguing about where she was, What day it was. Don'tcall the police-call us- in other words. It's OK!

There were several other episodes like this. This is not happening anymore that is that I can remember. Some people who have heard this say they have had similar experiences only they don't have my excuse. Could be.)

Back to my original topic. In other words I had some serious brain damage. I read the demand letter this assistant gave me. I was able to discern that some of the statements were not correct. I then forgot about it. I don't remember how long after this that I was called to set up a meeting with Enten, in Denver. He told me at this meeting what the offer was from State Farm. $42,000. He would take $21,000. The medical bills were over $25,000. I was told by the adjusters in the beginning that they took the medical out of the offered amount. My puny brain was spinning. Another shocking experience. What had I done in picking Enten? He told me that State Farm was was putting a $100, 000 toward the medical.. I called SF, I believe I spoke with Margie Oswald, who told me this was not true. The $42,000 was however. The Potts, Bridgeman policy had $100,000-$300,000 liability. I refused the offer. I received a call from Enten himself who would insist that I should take the offer and adamantly(actually harshly) gave reasons why, by using the weaknesses in my situation ,which had nothing to with the case, to justify the ridiculous offer. Shocked out of what mind I had left I fired the wretch. He told me if I hired someone else he would put a lien on anything I received. I could hardly comprehend what had happened. We live in an evil world. BUT- he was my advocate. I was weak, with a traumatic brain injury, in serious pain. What kind of greedy, insensitive monster was he?
When I called the Department that takes complaints about lawyers I got the impression that he was not the only one out there who was scamming people in this way.

Are the lawyers the foundation of how corrupt this auto insurance industry is? If you read the article I wrote( the beginning of the blog) I had mentioned the books , Deny, Delay Defend and the Vulture Culture. They don't emphasize this arena enough. The articles written by Richard E. Stewart (many in the 1970's) hold lawyers accountable. Our government is dominated by lawyers. they legislate, then capitalize on their legislation. BACK TO:
IT'S OUR MONEY!

IT'S OUR MONEY- PEOPLE!

WAKE UP!

April 17, 2013

It has been sometime since I have made a contribution to my cause. I was dealing with another accident situation involving an elevator at a U-Haul storage unit. In this situation Republic Western Insurance Company handles U-Haul claims. Again the typical insurance strategy of deny, delay, defend came into play. In this case I was told by the investigator from RWIC that a lawsuit in my name was filed against the elevator company Thyssen Krupp. I knew nothing about it. In each situation starting with the 1999 accident through the elevator accident, that's three auto accidents and this elevator accident, there were extenuating circumstances that appeared to fraudulent.

I am held back because of the injuries. I seem to be able to do only one thing at a time. I still have seizures, minor compared to what they were and of course the pain levels are horrible. I've been on Ultram since 2000, and since they came out with time released tablets the pain can be kept under some kind of control. Pain levels depend on how I use my body.  It slows me down. I so want to bring about reform.

In the last couple of years the focus turned to the legal system and lawyers. Are lawyers behind all the corruption.I have been overwhelmed by their control not only from the point of view of the victims in personal injury situations but those who work for the insurance companies. My experience in the 1999 accident revealed the levels of greed and extortion in the present system.I still don't grasp how we got to the place where we pay these bottomfeeders 30 to 40 % of our settlements. How did we get so duped.

The following is a detailed example of  the 2008 accident and how a lawyer Clifford Enten out of Denver, Colorado managed to take an easy claim situation and turn it into a nightmare.
To begin the perpetrator, other driver , was 100% at fault. I was seriously injured. Eventually it was found out that the car he was driving was insured by his girlfriend and her mother.Insurance was State Farm. The Vulture Culture. It is now known that a computer system is used to determine a settlement, at least in part. This might be a good reason to hire an attorney along with the fact that the adjusters are educated to keep from paying the victims. The adjusters in my case were led by a David Bacca and along with several other claims people like Margie Oswald, started by quoting a settlement that would not cover basic medical. They refused to give me basic information like the liability amounts on the policy of Marion Potts and Robin Bridgeman. A Daniel Vasques was the driver. This leaves the victim having to search for an attorney. I spoke to about five trying to discern who might do the best job. I found Clifford Enten through the phone book. I was called by a representative who met with me in Colorado Springs. A Greg Alderman. He claimed to be an ex- insurance adjuster who is working for the other side now. He really put on a good show. Sounded like he understood the problems with the insurance industry and how to handle the claims. I was assured of their doing a excellent job with a reasonable settlement. Since he claimed to have worked for the other side I felt confident in finally choosing this firm to work my case. I didn't know until I was getting ready to sign that Enten charged 40% instead of the 30% percent of the attorneys I spoke to in Colorado Springs. Alderman said they would take 30% since I this was the norm for other attorneys. I was told Enten charged 40% because he was that good. After I signed I spoke with him over the phone. He was very welcoming. I felt confident he would do an excellent job.

At this point I was suffering from seizures, I was loosing days at a time. In the accident I had been gashed in the head and I couldn't feel my arms. Obviously there was some kind of nerve trauma from the cervical spine.   I will continue this later.

January 31, 2013
I am so slow at getting things done. I have had 2 brain injuries, ischemic strokes, and have several structural problems that create constant pain. But I have resolved to get this message out there and get the radical change needed.
I wrote the following summary to submit to the FBI.

The following is a summary of four accidents, starting in 1999. My story involves the insurance industry and all the entanglements that surround it. A part of this is the defrauding of Medicare and Medicaid of monies owed to them by our auto insurance companies. They put liens on the insurance claims. The negative consequences of the fraudulent use of our money are huge. With Obamacare coming into the mix, there will be more abuses of our money.
This whole issue needs to be investigated and brought before the people who pay the bills.

Nov.1, 1999
Auto accident, Farmers Insurance Company
Corrupt actions started with a cop who produced two separate accident reports, both with false information. Eventually a local insurance agent would admit to being involved. There is suspicion regarding a local charter school and the use of family records that could have been tied into the accident.

Although my insurance policy was loaded with benefits and Colorado had no fault insurance whereby state statutes supported the payment of benefits to the claimant, Farmers adjusters manipulated ways to get out of paying. Local lawyers refused my case based on the amount of work vs the amount of money they would make, the case was too complicated. Farmers would tell me I did not need an attorney, but refused to pay or give guidance through the tightly woven system. The state insurance commission was uncooperative.

The police officer on the scene never talked to me to see if I was injured. It turned out that I was seriously injured internally. There were bruises and swelling externally. He also falsified
the damage on my vehicle making it look like I was at fault. Pictures show this.
I was not only suffering from the trauma of the accident but also the injuries and the sloppy way the case was handled. The obvious lying threw me, especially when it came from a doctor. I was so traumatized by the lying and the revelation of all the corruption that following experiences would be tainted. My ability to judge soundly would be hindered by fear, almost terror.

2003 accident

An illegal drove through a red light staring at me. There was a woman in the back seat holding a baby. I saw her coming but she moved her car into mine putting a scratch on her door and as she moved forward hooked her car onto my front fender. It eventually came off. She was obviously at fault but not ticketed. There would be no mention of the lady in the back seat.
I was ticketed for no insurance. I was fined and told to go to court, when I went down to investigate
about the time of the court appearance, I missed the date and there was a bench order, I was arrested and held with a $2000 bond, 3days in jail, My fine was $200. A judge Sletta was involved. He would later claim that he was following the district attorney's orders. What an experience. I've never used the F word. I heard it more times in an hour than I would hear it the rest of my life.
The court awarded a sum of money to the illegal although it was her fault, stating that the reason for this was that" I didn't care???" She had American Family Insurance who refused to pay. She claimed to be injured. Because I stopped before impact the cars were the only injured parties and this because she deliberately moved her car into mine.

2008, April 1 (fool's day)

A Hispanic male ran through a red light, hit my car (totaled it), ran from the scene. He was caught. I was told he was drugged and drunk. I was gashed in the head, my arms were paralyzed. He claimed to not have insurance but the car was insured by the girlfriend and mother with State Farm. The daughter claimed she gave the boy permission to drive. I was not given insurance info for about two weeks. I had dropped my uninsured motor vehicle insurance about two weeks before the accident. I had brain damage, a TBI and multiple problems associated with this. I would gain some function with my arms but still have tremors, numbing, that interfere with many tasks.

State Farm started the tactics of deny and delay.

I hired an attorney, Clifford Enten. I hired him after meeting with a man who said he was his representative in Colorado
springs. He was impressive but a fraud, as I would find out later. I would meet with Enten about 1 and 1/2 years later. At this time I was told State Farms settlement offer was $42,000 from which Enten would take $21,000. The initial medical bills were $25,000.
He told me State Farm was paying $100, 000 in medical which turned out to be untrue. I spoke with a Margie Oswald who denied that State farm said this. I questioned Enten about the rep that met with me. Enten did not know him. I had a business card with his name and the reps name on it. Through a phone call, I refused the offer but Enten became belligerent trying to convince me that this was right. He and Margie Oswald of State Farm, needed to get their stories straight. I fired the attorney, who said he would file a lien on any money I get from the case. Enten knew the extent of my injuries and was probably banking on them to pull the wool over my eyes. I was stunned and overwhelmed.

2010, January (two different dates were claimed)

Elevator accident. A portion of the service elevator dropped on my head at a U-Haul storage facility. I would suffer a stroke about 5 days later. This happened before a settlement was offered by State Farm. I told Enten's assistant about it who would contact me shortly after telling me that Enten wanted to get the state Farm case out of the way. An investigator from the insurance company with U-Haul company came by my apt. I was told that a lawsuit in my name was filed against the elevator company. I'm still battling with them, which is an incredible story. Is Enten involved here? $18,000 in initial medical bills.

Farmers was required to settle with me within 10 years. I had contacted them many times to get this done.

I have not been paid yet.

Enten is somehow involved in all this.

The fact is that automobiles are being used as weapons for financial gain in more cases than are recorded. More people die or are severely injured every year than war, 911,etc. In my case every injury was deliberate.

When I staggered out the door of the storage building, the manager was right out there and just said he hired a nit-wit who over oiled it.There were no signs indicating this.

The rewarding of illegals for using their vehicles as weapons for financial gain is insane. There was a drug connection with the 2008 accident. I looked up the court records and found out Daniel Vasques was claiming a TBI.

I am going to write somewhere about greed- what people are doing to get money.Any ideas.
Please think about how the people can take charge of our money especially in the auto insurance industry. It is big business and no longer serves it's purpose for those who support it. So goes the medical establishment and I dare say the "churches"

enough

January 10, 2013

My experience with the insurance industry has extended to the accident with U-Haul corporation. In 2010 part of the service elevator dropped on my head as I was entering the elevator. There were no warning signs that the elevator door was faulty. It hit me on the head just behind the scar of the auto accdent just 2 years before. I staggered out to find the manager just out side the building. I told what happened then he answered with the comment that the elevator had been overoiled by a nit-wit he had hired.
I would end up going to the emergency room of Penrose Hospital and was admitted with the symptoms of a stroke. I was released the next day. A claim was filed by one of the employees who disappeared a few weeks later from the facility. Maybe fired? I spoke with the insurance company that covers U-Haul, Republic Western several times over the two years. Close to end of the statutes of limitations they were not going to cooperate so I filed a lawsuit with the U-Haul Corp. They sent an attorney from Phoenix, Az and another from Denver to get the case dismissed. What they paid these two would have covered the amount I was asking for which would have paid the medical and additional needs for some extended care.
I have suffered from brain damage. I had paid for my stroage thru an auto pay for years. In Oct. just before the hearing to see where the case would go I was told by one of the workers that my stuff would be sold in three days. I was trying to find out what had happened to the missing money from my account. I really believe that they think that the brain damage has caused enough dementia to fool me. One thing I realised when I found out how much damage was done I could still discern a level of wrong. I tried to move my stuff to a new storage but my body started to cave in. I needed help that I could not afford. They continue to refuse to pay and are hold my stuff instorage as hostage to get what they want which is what I am not sure.Tomorrow I will detail what State Farm has done.

January 9,2013

Into a new year. I am just now getting back to blogging. I have been fighting the insurance company involved with U-haul Corporation. They can get ugly. Today I am posting an article that I wrote July 25, 2012. It is just as I wrote it then and sent it to be published in theWall Street Journal.

Since 1999 I have been experiencing a wakeup call. Not unlike the Tea Party Movement that would take place about seven years later. November 1, 1999 I experienced the first of 3 auto accidents and an elevator accident. I was seriously injured in the 1999 and 2008 accidents, then the elevator accident. I had the naive notion that should I experience an auto accident in which I was injured my insurance would cover the experience.
The November 1, 1999 event started a series if incidences that would unveil how corrupt and complicated the auto insurance industry is, as the books the Vuture Culture and Delay, Deny, Defend would reveal later in 2010. About a year after the 1999 accident I came across writing by Richard E. Stewart. He wrote in 1978 what I was living through and some of what the other two books would cover more extensively. They all empahsized the need for reform. Not just lowering payments.
(federalizing is not the solution)
I was well insured by Farmers who started to pay along the no fault lines the state of Colorado had at the time but after a few weeks they started some delay tactics then denial. I contacted several attorneys in Colorado Springs, Co. One after another said they would not take the case, reasons being- El Paso County was too conservative and settlements were too low, my case was complicated and that an attorney would not make enough money off of me.
During this time the thought that these companies are using OUR money to support a system that is complicated and corrupt instead of stewarding our money for the benefit of its supporters kept coming to mind. I kept thinking-But It's Our Money! Sounds like the outcry of the Tea Party Movement. Then the question- Why are we allowing this?
Colorado would change from the no-fault system to the tort system. This would establish an even greater no win situation for the consumer, essentially, defrauding the American middle class. Also auto insurance would become mandatory. It is a form of taxation. Sounds a little like Obamacare to me. Now in all 50 states, auto insurance is mandatory. There are also punitive laws now for not having insurance.
Again it is our money.

Some thoughts and questions!

Are insurance agents still paid a commission off of mandatory payments?
Lawyers scam the system making everything complicated. It's our money!
Adjusters(claim representatives) make decisions managing our money based on computer programs and company profits as well as their own benefit. Special favor and awards -like the Vulture awards(State Farm) are given out to employees.
Medical personnel are paid to minimize physical consequences of injuries endangering the welfare of victims. Bottom line they lie.
Then there are those who use the vehicle as a weapon to cause an accident with monetary gain as their motive. This is criminal. There seems to be no thought of the consequences of injury or the possibility of manslaughter.
Why do these insurance companies spend so much money on advertising when insurance is mandatory.

OUR MONEY SUPPORTS THIS! WE PAY COMING AND GOING!

I read this statement in one of the writings. "Pursuing an insurance claim is like running a marathon on a stretcher with IV's" In my case it has been worse. The system was set up to insure recovery not hinder or prolong it or even destroy the chances of recovery.
Yes, there is fraud against the insurance companies but I suspect it is no where near what the companies claim. The real fraud is toward the real victims if vehicular crime. For example in situations where someone runs a red light, drugged, drunk or setting up accidents or neglecting to post warning signs of dangerous, faulty equipment and the insurance company delays, denies or forces a claimant to defend. Then there are waste and other forms of mismanagement of our money.

WHO DEFRAUDS WHO?
